1. Data controller
Smart Property Software LTD is the data controller for personal data collected through Captured Motion and the capturedmotion.tech website.
2. Lawful bases
- Contract (Art. 6(1)(b)) — to deliver your purchase and provide support.
- Legitimate interests (Art. 6(1)(f)) — to secure the service, prevent fraud and respond to enquiries.
- Legal obligation (Art. 6(1)(c)) — for tax record keeping.
3. Categories of data
Identity data, purchase data, licence or account data, support correspondence, and limited diagnostic data where collected. Mac App Store purchase/referral records are limited to StoreKit transaction identifiers, product IDs, app account tokens and referral metadata. Camera footage is not collected or transmitted to us.
4. Data subject rights
You have the right to access, rectify, erase, restrict, port, and object to processing of your personal data, plus the right to withdraw consent where consent is the basis. Most rights can be exercised at any time via the contact form. We will respond within one month.
5. Right to complain
If you are unhappy with how we handle your data you may complain to the UK Information Commissioner's Office at ico.org.uk.
6. Data Protection Officer
A statutory DPO is not required for our scale of processing. Data protection enquiries should be addressed via the contact form on the Site.
7. International transfers
Personal data we store is held on servers in the European Union. Apple may process App Store purchase data under Apple's own privacy terms and international transfer safeguards.
8. Breach notification
In the unlikely event of a personal data breach affecting your rights and freedoms, we will notify the ICO within 72 hours and inform affected individuals without undue delay.
9. Privacy by design
Captured Motion is designed to minimise the data we hold. Camera streams do not pass through our servers, and we collect no third-party advertising or analytics trackers on the website.
