Terms of Service
1. Acceptance
By downloading, installing or using the App, or by using the Site, you agree to these Terms. If you do not agree, do not use the App or the Site.
2. Licence grant
Subject to your compliance with these Terms and payment of any applicable fees, we grant you a personal, non-exclusive, non-transferable, revocable right to use the App on Mac computers you own or control, in line with Apple's Mac App Store rules and these Terms.
3. Restrictions
You may not: (a) resell, sublicense, rent, lease, lend or otherwise transfer the App or your licence key; (b) reverse engineer, decompile or disassemble the App except to the extent permitted by mandatory law; (c) remove or alter copyright notices; (d) use the App to break any law or to infringe anyone's rights.
4. Free trial and promotions
Any free trial, introductory offer, promotional period, or reward month for the Mac App Store App is handled through Apple's in-app purchase system or through StoreKit-compatible entitlement records. Availability may vary by product, territory, and Apple account.
5. Pricing & payment
The public App is distributed through the Mac App Store. Purchases and subscriptions are processed by Apple using Apple's in-app purchase system. Prices are shown in the Mac App Store in the applicable currency and may include local taxes. We do not receive your full card details.
6. Refunds & cancellation
For Mac App Store purchases and subscriptions, cancellation, renewal management, and refund requests are handled by Apple under Apple's own App Store terms and processes.
7. Updates
We may release updates to the App at our discretion. Public App updates are delivered through the Mac App Store.
8. Camera footage stays local
Captured Motion processes camera streams entirely on your Mac. No video frames, snapshots or recorded clips ever leave your network or pass through our servers.
9. Disclaimer of warranty
The App is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or suitable for any specific purpose, including (without limitation) home security, evidence collection, or compliance with any regulation. You are responsible for your own security setup.
10. Limitation of liability
To the maximum extent permitted by law, our total liability to you arising from or in connection with these Terms or the App will not exceed the amount you have paid us in the 12 months preceding the event giving rise to the claim. We are not liable for any indirect, incidental, consequential, or punitive damages, or for loss of profits, data, goodwill or property, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under English law (including for death or personal injury caused by negligence, or fraud).
11. Termination
We may suspend or terminate your licence if you breach these Terms. On termination, your right to use the App ends and you must uninstall it.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified via the Site or in the App. Continued use after a change constitutes acceptance.
13. Governing law
These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
